Terms of Service

These Terms of Service ("Terms") govern your use of the Omiyage mobile application ("Service") operated by Omiyage ("we", "our", or "us").

Acceptance of Terms

By downloading, installing, or using Omiyage, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Account Registration

To use Omiyage, you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials and for all activity under your account.

Use of the Service

Omiyage is a personal keepsake management app. You may use it to:

Scan, photograph, and store images of personal keepsakes
Add metadata and notes to your saved items
Search and organize your collection

You agree not to use the Service to store, upload, or distribute illegal, harmful, or offensive content.

Content Ownership

You retain full ownership of all content you upload to Omiyage. We do not claim any rights to your photos, scans, or metadata. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

Subscriptions and Billing

Omiyage offers a free tier with limited storage and items, as well as premium subscription plans with expanded features.

Subscriptions are billed through your Apple ID or Google Play account.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You can manage or cancel subscriptions in your device's account settings (Settings > Apple ID > Subscriptions on iOS).
No refunds are provided for partial billing periods.

Free Tier Limitations

The free tier includes a limited number of keepsakes and storage. Once you reach these limits, you will need to upgrade to a premium plan to continue adding items.

Service Availability

We strive to keep Omiyage available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime. We are not liable for any loss resulting from service interruptions.

Data and Backups

While we take reasonable measures to protect your data, you are responsible for maintaining your own backups of important content. We are not liable for data loss.

Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, Omiyage is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the applicable jurisdiction.
